Syarat dan Ketentuan

Selamat datang di Gomuda. Syarat dan Ketentuan menguraikan aturan dan regulasi dalam melakukan pembelian produk di Situs Web Gomuda.

Pembeli wajib membaca dan menyetujui isi Syarat dan Ketentuan ini sebelum melakukan transaksi pembelian di Gomuda. Jika Pembeli tidak menyetujui isi Syarat dan Ketentuan ini, Pembeli sangat disarankan untuk tidak melakukan transaksi pembelian di Gomuda.

Dengan mengakses, menelusuri, atau berbelanja di situs web ini, Anda menyetujui semua syarat dan ketentuan dalam perjanjian ini. Silakan baca dengan cermat.

A. Ketentuan

  1. “Gomuda” adalah bisnis perorangan/CV/perseroan dengan nama dagang Gomuda.
  2. “Situs Web Gomuda” berarti situs yang menampilkan Produk dan Harga Gomuda untuk dijual kepada Pembeli.
  3. “Produk” adalah barang-barang Gomuda yang dijual sebagaimana tercantum dalam katalog produk di situs web Gomuda.
  4. “Harga” adalah harga dalam mata uang Rupiah untuk setiap Produk yang dijual di Gomuda.
  5. “Perjanjian” adalah kesepakatan antara Pembeli dan Gomuda mengenai Produk dan Harga yang terjadi ketika Pembeli setuju untuk membeli Produk dengan mengirimkan Formulir Pemesanan dan Gomuda mengirimkan konfirmasi bahwa Pesanan telah diterima. Dalam Perjanjian, Pembeli wajib membayar Harga dan Toko Online wajib mengirimkan Produk.
  6. “Formulir Pemesanan” adalah formulir yang harus diisi Pembeli untuk memesan Produk yang dibeli, yang berisi rincian Nama Pembeli, Alamat, Nomor Telepon, Produk (beserta jumlah, warna, jenis, dan harga), Cara Pembayaran, dan Metode Pengiriman yang secara otomatis dikeluarkan oleh sistem kepada Pembeli sebelum Pembeli menyelesaikan pembelian.
  7. “Pesanan” mengacu pada Produk yang akan dibeli oleh Pembeli meliputi jumlah, warna, jenis, dan harga.

     

B. Produk dan Harga

  1. Produk dan informasi atau gambaran keseluruhan Produk yang ditampilkan di Situs Web Gomuda adalah akurat, benar dan sesuai dengan keadaan sebenarnya. Perbedaan warna dapat terjadi tergantung pada komputer/tablet/monitor seluler Pembeli.
  2. Pembeli mengakui bahwa warna sebenarnya dari Produk seperti yang terlihat di Situs Web Gomuda bergantung pada monitor komputer/tablet/seluler Pembeli. Gomuda telah melakukan upaya terbaiknya untuk memastikan bahwa warna di setiap foto yang ditampilkan di Situs Web Gomuda akurat, tetapi tidak dapat menjamin bahwa warna yang muncul di Situs Web Gomuda akan sepenuhnya akurat.
  3. Harga yang ditampilkan di Situs Web Gomuda akurat dan berlaku pada saat dicantumkan. Harga dapat berubah sewaktu-waktu, namun perubahan tersebut tidak akan mempengaruhi Pesanan yang telah dikonfirmasi oleh Gomuda. Pembeli hanya akan membayar harga yang tertera pada Formulir Konfirmasi Pesanan.
  4. Gomuda bertanggung jawab atas ketersediaan semua Produk yang ditampilkan di Situs Web Gomuda. Jika stok produk tidak tersedia atau out of stock, Gomuda akan mencantumkan pernyataan bahwa produk tersebut tidak tersedia atau out of stock.
  5. Stok produk dapat berubah sewaktu-waktu, sehingga jika stok produk kosong, maka Gomuda berhak menolak pesanan dari pembeli, dan pembayaran atas produk yang bersangkutan dikembalikan kepada pembeli.
  6. Pembeli wajib membaca, memahami, dan menyetujui informasi/deskripsi seluruh Produk dan Harga sebelum melakukan penawaran atau komitmen pembelian dengan mengisi Formulir Pemesanan.

     

C. Proses Pemesanan

  1. Pembeli dianggap telah memahami, mengakui, menerima dan menyetujui Produk dan Harga serta deskripsi dan kondisi Produk seperti pada saat Pembeli mengirimkan Formulir Pemesanan kepada Penjual.
  2. Gomuda akan mengirimkan pemberitahuan penerimaan pesanan yang menyatakan bahwa pesanan telah diterima, ringkasan pesanan dan instruksi pembayaran untuk Pembeli.
  3. Apabila Pembeli menemukan kesalahan dalam penulisan data pada Formulir Pemesanan, Pembeli dapat segera menghubungi Toko Online melalui fitur chat atau nomor yang tertera pada Situs Web Gomuda.
  4. Pembeli dan Gomuda menyatakan bahwa Perjanjian ditandatangani secara sah ketika Gomuda mengirimkan pemberitahuan penerimaan Pesanan.
  5. Jika Pembeli memilih untuk membayar di tempat (Cash On Delivery/COD), maka jangka waktu pembayaran diberikan selama sesuai dengan informasi yang tertera pada saat pembelian. Jika tidak ada pembayaran setelah jangka waktu tersebut, pesanan akan otomatis dibatalkan. Untuk pengiriman COD, Pesanan akan dikirimkan setelah Gomuda memberi tahu Pembeli bahwa Pesanan telah diproses.
  6. Setelah Pembeli melakukan Pembayaran dan mengkonfirmasi Pembayaran diterima oleh Gomuda, Gomuda akan mengirimkan pemberitahuan kepada Pembeli bahwa Pesanan akan segera diproses.
  7. Gomuda akan mengirimkan pemberitahuan kepada Pembeli saat Pesanan akan dikirimkan dan sedang dalam proses pengiriman sampai Pesanan tiba di tempat tujuan.
  8. Cakupan wilayah pengiriman tergantung ketersediaan kurir J&T yang bisa dicek melalui Situs Web Gomuda.

     

D. Pembayaran

  1. Pembayaran dilakukan oleh Pembeli dalam mata uang Rupiah (IDR).
  2. Pembayaran Pesanan dapat dilakukan melalui kartu kredit; kartu debit; transfer bank; e-banking; m-banking; OVO; ShopeePay; pembayaran di Alfamart; PayLater (Akulaku); atau bayar di tempat (Cash On Delivery/COD) atau melalui transfer bank langsung ke rekening Toko Online di nomor rekening yang tertera di situs web Gomuda.
  3. Untuk setiap jenis pembayaran, Pembeli akan dikenakan biaya administrasi sebagai berikut:
    Kartu Kredit/Kartu Debit: 1,5% dari Nilai Transaksi*
    OVO: 1% dari Nilai Transaksi*
    ShopeePay: Rp0
    Toko Serba Ada (Alfamart, Indomaret): Rp2.500
    Transfer Bank (ATM, e-banking, m-banking): Rp0
    PayLater (Akulaku): 1% dari Nilai Transaksi*
    COD : 3% dari Nilai Transaksi*
    *Nilai Transaksi adalah harga produk + ongkos kirim
  4. Pembayaran dianggap lunas jika jumlah uang yang diterima Gomuda sesuai dengan jumlah yang harus dibayar sesuai dengan yang tercantum dalam Formulir Pemesanan. Pembeli diharuskan untuk segera melakukan konfirmasi pembayaran melalui fitur Konfirmasi Pembayaran yang tersedia di situs web Gomuda atau menghubungi kami melalui fitur chat.
  5. Gomuda tidak bertanggung jawab atas keterlambatan atau penolakan dalam proses transfer antar bank, masalah di ATM, penolakan proses kartu kredit atau debit Pembeli, masalah dengan sistem pembayaran OVO, Akulaku, dan/atau ShopeePay. Dalam hal ini, Pembeli dapat menghubungi bank atau penyedia kartu kredit atau penyedia layanan pembayaran.
  6. Gomuda tidak bertanggung jawab atas kelalaian Pembeli dalam penulisan nama, nomor rekening Gomuda, dan informasi transfer atau kelalaian bank pada saat Pembeli melakukan pembayaran.
  7. Untuk pembayaran dengan COD, Pembeli akan membayar langsung secara tunai sesuai harga yang tertera di Formulir Pemesanan kepada petugas jasa pengiriman pada saat Pembeli menerima Pesanan.

     

E. Masa Perlindungan Pembeli

  1. Saat menerima Pesanan, Pembeli harus segera memeriksa kondisi Produk dan memastikan kebenaran, jumlah, dan kualitas Produk yang diterima.
  2. Apabila pesanan yang diterima Pembeli tidak sesuai, mohon untuk menghubungi kami secara langsung melalui fitur chat yang terdapat pada situs web untuk melakukan penyelesaian sesuai ketentuan yang telah disepakati.

     

F. Pengajuan Keluhan

Kami selalu memeriksa dan memastikan kualitas dan kuantitas produk sesuai dengan format pemesanan yang telah disetujui oleh Pembeli sebelum dikirim. Namun, jika Pembeli memiliki keluhan berupa cacat produksi, produk rusak, kadaluarsa, atau produk tidak sesuai dengan yang ada di Formulir Pemesanan, Pembeli dapat mengajukan keluhan melalui fitur chat dan kami senang untuk menangani masalah pembeli.

G. Penyelesaian Sengketa

  1. Segala perselisihan yang berkaitan dengan Syarat dan Ketentuan, Perjanjian, dan hubungan hukum antara Pembeli dan Gomuda akan diselesaikan terlebih dahulu secara musyawarah.
  2. Jika penyelesaian secara musyawarah tidak dapat dicapai, kedua belah pihak sepakat untuk menyelesaikan sengketa tersebut di Pengadilan Negeri sesuai dengan wilayah tergugat.

     

H. Hukum

Syarat dan Ketentuan, Perjanjian, serta hubungan hukum antara Pembeli dan Gomuda dan segala akibat hukum terkait penggunaan Situs Web Gomuda dan transaksi pembelian di Gomuda diatur dan ditafsirkan berdasarkan hukum Republik Indonesia.

I. Pelayanan Pelanggan

Gomuda selalu berkomitmen untuk memberikan pelayanan terbaik bagi pelanggan. Jika pelanggan memiliki masalah dalam menggunakan Situs Web Gomuda, pertanyaan, komentar, atau saran, pelanggan dapat menghubungi kami di fitur chat atau email.

KEBIJAKAN PRIVASI

Kebijakan Privasi adalah ketentuan mengenai jenis informasi pribadi yang diperoleh Pembeli, cara menggunakan informasi tersebut dan cara menyimpan informasi.

Gomuda menjaga privasi dengan sangat serius. Kami percaya bahwa privasi elektronik sangat penting bagi keberhasilan berkelanjutan penggunaan Internet.

Kami percaya bahwa informasi ini hanya dan harus digunakan untuk membantu kami menyediakan layanan yang lebih baik. Itulah sebabnya kami menempatkan kebijakan untuk melindungi informasi pribadi pelanggan.

Perlindungan Informasi Pribadi

  1. Dalam memberikan pelayanan terbaik kepada Pembeli, Gomuda akan membutuhkan data Pembeli seperti nama, alamat, nomor telepon, email, dan bukti transfer pembayaran.
  2. Dengan mengisi Formulir Pemesanan, pembeli dianggap telah setuju untuk memberikan data kepada Gomuda untuk keperluan pengiriman produk dan Gomuda berjanji untuk menjamin kerahasiaan data yang diberikan kepada Gomuda.

     

     

Terms and Conditions

Welcome to Gomuda. The Terms and Conditions outline the rules and regulations for purchasing products on Gomuda’s Website.

The Buyer must read and agree to the contents of these Terms and Conditions before making a purchase transaction at Gomuda. If the Buyer does not agree to the contents of these Terms and Conditions, the Buyer is strongly advised to not make a purchase transaction at Gomuda.

By accessing, browsing, or shopping on this website, you agree to all the terms and conditions in this agreement. Please read them carefully. 

A. Definition

  1. “Gomuda” is an individual business/CV/limited company under the trade name Gomuda.
  2. “Gomuda Website” means a site that displays Gomuda Products and Prices for sale to Buyers.
  3. “Products” are Gomuda goods sold as listed in the product catalog on the Gomuda website.
  4. “Price” is the price in Rupiah currency for each Product sold at Gomuda.
  5. “Agreement” is an agreement between Buyer and Gomuda regarding Products and Prices that occurs when Buyer agrees to purchase Products by submitting an Order Form and Gomuda sends confirmation that the Order has been received. In the Agreement, the Buyer is obliged to pay the Price and the Online Store is obliged to send the Product(s).
  6. “Order Form” is a form that the Buyer must fill out to order the purchased Product, which contains details of the Buyer’s Name, Address, Telephone Number, Product (along with quantity, color, type, and price), Payment Method, and Shipping Method which are automatically issued by the system to the Buyer before the Buyer completes the purchase.
  7. “Order” refers to the Product to be purchased by the Buyer including quantity, color, type, and price.

B. Products and Prices

  1. The product and the information or overall description of the Product displayed on the Gomuda Website are accurate, true, and in accordance with the actual situation. Color differences may occur depending on the Buyer’s computer/tablet/mobile monitor.
  2. The Buyer acknowledges that the actual color of the Product as seen on the Gomuda Website depends on the Buyer’s computer/tablet/mobile monitor. Gomuda has made its best efforts to ensure that the colors in each photo displayed on the Gomuda Website are accurate, but cannot guarantee that the color that appears on the Gomuda Website will be entirely accurate.
  3. Prices displayed on the Gomuda Website are accurate and in effect at the time they are listed. Prices are subject to change at any time, however, changes will not affect Orders that have been confirmed by Gomuda. The buyer will only pay the price stated on the Confirmed Order Form.
  4. Gomuda is responsible for the availability of all Products displayed on the Gomuda Website. If the product stock is not available or out of stock, Gomuda will include a statement that the product is not available or out of stock.
  5. Product stock can change at any time, so if the product stock is empty, then Gomuda has the right to refuse an order from the buyer, and payment for the product in question is returned to the buyer.
  6. Buyers must read, understand, and agree to the information/description of the entire Product and Price before making an offer or commitment to purchase by filling out the Order Form.

C. Order Process

  1. The Buyer is deemed to have understood, acknowledged, accepted, and agreed to the Product and Price as well as the description and condition of the Product as it was when the Buyer sent the Order Form to the Seller.
  2. Gomuda will send an order acceptance notification stating that the order has been received, a summary of the order and payment instructions for the Buyer.
  3. If the Buyer finds an error in writing data in the Order Form, the Buyer can immediately contact the Online Store via the chat feature or the number listed on the Gomuda Website.
  4. Purchaser and Gomuda declare that the Agreement is legally entered into when Gomuda sends a notification of acceptance of the Order.
  5. If the Buyer chooses to pay on the spot (Cash On Delivery/COD), the completion of the time for making the payment is given as long as it is in accordance with the information stated at the time of purchase. If there is no payment after that time period, the order will be automatically canceled. For COD delivery, Orders will be shipped after Gomuda has notified the Buyer that the Order has been processed.
  6. After the Buyer makes a payment and confirms the payment is received by Gomuda, Gomuda will send a notification to the Buyer that the Order will be processed immediately.
  7. Gomuda will send a notification to the Buyer when the Order will be shipped and is in the process of being shipped until the Order arrives at its destination.
  8. The delivery area coverage depends on the availability of the J&T courier which can be checked via the Gomuda Website.

D. Payment

  1. Payment is made by the Buyer in Rupiah (IDR).
  2. Payment for Orders can be made via credit card; debit card; bank transfer; e-banking; m-banking; OVO; ShopeePay; payment at Alfamart; PayLater (Akulaku); or pay on the spot (Cash On Delivery/COD) or by bank transfer directly to the Online Store account at the account number listed on the website.
  3. For each type of payment, the Buyer will be charged the following administration fees:
    Credit Card/Debit Card: 1.5% of Transaction Value*
    OVO: 1% of Transaction Value*
    ShopeePay: Rp0
    Convenience Store (Alfamart, Indomaret): Rp2,500
    Bank Transfer (ATM, e-banking, m-banking): Rp0
    PayLater (Akulaku): 1% of Transaction Value*
    COD : 3% of Transaction Value*
    *Transaction Value is product price + shipping fee
  4. Payment is considered paid if the amount of money received by Gomuda is in accordance with the amount to be paid as stated in the Order Form. Buyers are required to immediately confirm the payment through the “Payment Confirmation” feature available on the Gomuda Website or contact us via the chat feature.
  5. Gomuda is not responsible for delays or refusal in the interbank transfer process, problems at ATMs, rejection of Buyer’s credit or debit card processes, problems with OVO, Akulaku, and/or ShopeePay payment systems. In this case, the Buyer can contact the bank or credit card provider or payment service provider.
  6. Gomuda is not responsible for the negligence of the Buyer in writing the name and account number of Gomuda and transfer information or the negligence of the bank when the Buyer makes the payment.
  7. For payment by COD, the Buyer will pay directly in cash according to the price listed in the Order Form to the delivery service officer when the Buyer receives the Order.

E. Buyer Protection Period

  1. When receiving an Order, the Buyer must immediately check the condition of the Product and ensure the correctness, quantity, and quality of the Product received.
  2. If the order received by the Buyer does not match, please contact us directly via the chat feature found on the website for settlement according to the agreed terms. 

F. Submission of Complaints

We always check and ensure the quality and quantity of the product are in accordance with the order form that has been approved by the Buyer before delivery. However, if the Buyer has a complaint in the form of a manufacturing defect, the product is damaged, expired, or the product does not match the one on the Order Form, the Buyer can file a complaint via the chat feature and we are happy to help with the Buyer’s problem.

G. Dispute Resolution

  1. All disputes relating to the Terms and Conditions, the Agreement, and the legal relationship between the Buyer and Gomuda will be resolved first by deliberation.
  2. If a deliberation settlement can not be reached, both parties agree to settle the dispute in the District Court according to the defendant’s territory.

H. Law

The Terms and Conditions, the Agreement, along with the legal relationship between the Buyer and Gomuda and all legal consequences related to the use of the Gomuda Website and the purchase transaction at Gomuda are governed and construed under the law of the Republic of Indonesia.

I. Customer Service

Gomuda is always committed to providing the best service for customers. If customers have problems using the Gomuda Website, questions, comments, or suggestions, customers can contact us on the chat or email feature.

PRIVACY POLICY

Privacy Policy is a provision regarding the types of personal information that Buyers obtain, how to use that information and how to store information.

Gomuda takes privacy very seriously. We believe that electronic privacy is crucial to the Internet’s long-term viability.

We believe that this information is only and should be used to help us provide a better service. That’s why we put in place a policy to protect customers’ personal information.

Personal Information Protection

  1. In providing the best service to Buyers, Gomuda will require the Buyer’s data such as name, address, telephone number, email, and proof of payment transfer.
  2. By filling out the Order Form, the buyer is deemed to have agreed to provide data to Gomuda for the purpose of shipping products and Gomuda promises to guarantee the confidentiality of the data provided to Gomuda.
